The sub-contractors contract

The sub-contractors contract is designed to secure the legal rights of builders who sub-contract some of their work to another company. For example, if the builder is doing a loft conversion and his company cannot install windows, then he will sub-contract that particular part of the work to windows installers. It then becomes his responsibility regarding pay and workmanship. Therefore, he should sign a sub-contractors contract with the window company - unless of course the client chooses otherwise and appoints their own window installer.

The contract outlines:

• the subcontractor’s responsibilities
• the contractor’s responsibilities
• access to site details
• interest owing for late payments to subbies
• when the work will start
• details of any payments withheld (stage payments are used to pay the subbie)
• details of the supply of materials for the project - who is supplying and of what quality
• insurance and who has what
• who has what liabilities
• who has what responsibilities for H&S
• defects
• liability periods
• what happens if there are disputes - and so on.

Notice of the right to cancel

To comply with the law businesses need to make changes to their contracts and include a 'Notice of the Right to Cancel' and a 'Cancellation Form' so you stay within the law including the Door Step Selling Regulations which you must comply with.

If you sell products and services worth over £42 to a customer at their home you must provide certain information for your customers, including their right to cancel. Failure to provide this information is a criminal offence.

This includes the sale of products and services to customers at their home, their workplace or another individual’s home.

4

Cancellation form

In the event that your customer does not want to proceed, in line with the 'Notice of the Right to Cancel' there is also a cancellation form included within the software which must be printed and included to allow for these regulations within the terms and conditions.

5

Start work now form

Your contract package also includes a 'Start Work Now Form' which must be prominently displayed in the contract document or accompanying terms and conditions if a customer wants you to go ahead before the cooling off period ends.

6

Changing works form

Easily manage your project and track any agreed changes to the work (variations) in your contracts as the project progresses. Simply print two versions to ensure you both have copies of the agreement of variations and the associated costs.

Once this document is signed by both parties there can be no confusion when the customer receives the invoice.
